Are the Requirements and Deadlines Different if You Were Hired by the General Contractor Versus a Subcontractor?

YES

The requirements and deadlines for making a Payment Bond Claim are different depending upon who hired you.  Therefore, the first step in determining how to proceed with making a Payment Bond Claim is to confirm who hired you.

If you were hired directly by the Governmental Entity, you are considered a Prime Contractor or a General Contractor and you do not have a right to make a Claim against the Payment Bond.

If you were hired by the Prime Contractor/General Contractor, then you are a First-Tier Subcontractor/Supplier.

If you were hired by a Subcontractor of any level, then you are considered a Second-Tier Subcontractor/ Supplier for the Payment Bond Claim process.  This category of Subcontractors/Suppliers is required to serve an additional Notice as a prerequisite to perfecting a Payment Bond Claim.
